2. Service Description

Jemakor provides educational content and a request channel for consultations related to energy storage systems for efficiency optimization. Our materials may cover topics such as peak demand management, renewable energy time shifting, self-consumption strategies, backup configuration concepts, and general considerations for sizing and operating battery-based storage.

The Site is not a marketplace and does not complete transactions for physical products. Any product references are informational and may describe categories, capabilities, and typical integration approaches. If you contact us, we may respond with next steps, clarifying questions, and suggestions for what data to collect to evaluate a potential storage project. Unless a separate written agreement is signed, no statement on the Site forms a binding offer or commitment.

Scope limitations are important for safety and compliance. Storage systems may be subject to electrical codes, fire safety rules, interconnection requirements, utility tariff provisions, and equipment-specific constraints. You are responsible for confirming suitability and compliance in your jurisdiction and for your site.

Jemakor does not warrant that the Site will be uninterrupted, error-free, or secure, or that any defects will be corrected. Jemakor does not warrant the accuracy, completeness, or usefulness of any content. Technical information related to energy storage and electrical systems can change based on evolving standards, site conditions, and equipment specifications. You are responsible for verifying any information before relying on it.

7. Limitation of Liability

To the fullest extent permitted by law, Jemakor will not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, loss of revenue, loss of data, business interruption, or cost of substitute services, arising out of or related to your use of (or inability to use) the Site, even if Jemakor has been advised of the possibility of such damages.

To the fullest extent permitted by law, Jemakor’s total liability for any claim arising out of or related to the Site or these Terms is limited to the amount you paid to Jemakor in the 12 months preceding the event giving rise to the claim, or one hundred euros (€100), whichever is lower. If you have not paid Jemakor any amount in that period, the cap is €100.

Some jurisdictions do not allow certain limitations of liability, so some of these limitations may not apply to you. In such cases, Jemakor’s liability will be limited to the maximum extent permitted by applicable law.

8. Indemnification

You agree to indemnify, defend, and hold harmless Jemakor, its officers, directors, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Site, (b) your violation of these Terms, or (c) your violation of any law or the rights of any third party.

9. Third-Party Links

The Site may reference or link to third-party websites, tools, or resources. These links are provided for convenience and do not constitute an endorsement. Jemakor does not control third-party sites and is not responsible for their content, availability, or practices. Your use of third-party sites is at your own risk and subject to their terms and policies.

11. Governing Law

These Terms and any dispute arising out of or related to the Site will be governed by the laws of the State of New York, United States, without regard to conflict of law principles. To the extent permitted by law, you agree that the courts located in New York County, New York, will have exclusive jurisdiction over any legal action or proceeding arising out of or related to these Terms or the Site.

12. Dispute Resolution

Before filing a claim against Jemakor, you agree to attempt to resolve the dispute informally by contacting us and providing a brief written description of the issue and your requested resolution. The parties will attempt in good faith to resolve the dispute within 30 days after we receive your notice.

If the dispute is not resolved within that 30-day period, either party may pursue a claim in the courts identified in the Governing Law section, subject to any applicable laws that provide you with mandatory rights or venue protections.

13. Termination

Jemakor may suspend or terminate your access to the Site (including any account features if applicable) at any time, with or without notice, if we believe you have violated these Terms, pose a security risk, or use the Site in a way that could harm Jemakor, other users, or third parties. You may stop using the Site at any time.

Sections that by their nature should survive termination will survive, including Intellectual Property, Disclaimer of Warranties, Limitation of Liability, Indemnification, Governing Law, Dispute Resolution, and Contact.

14. Modifications

We may update these Terms from time to time to reflect changes to the Site, legal requirements, or operational practices. Changes become effective 14 days after we post the updated Terms on this page, unless the changes are required by law or relate to urgent security issues, in which case they may take effect immediately.

Your continued use of the Site after the effective date of updated Terms constitutes your acceptance of the revised Terms. If you do not agree to the changes, you should stop using the Site.
